Section-A
- Read the statements mentioned below and quote the word or phrase in law that represents the same. (10×1=10)
- An order of the court restraining the wrong doer from doing, or continuing, the
wrongful act complained of . It is usually granted to enforce negative stipulations in cases where damages are not adequate.
- The rule of law or the underlying principle upon which a decision is founded and which gives it the element of authority.
- The relations subsisting between the parties are such that one of the parties is in a position to dominate the will of the other and uses that position to obtain an unfair advantage over the other.

Read the cases mentioned below and answer the questions that follow by not only quoting the respective law but also giving a suitable explanation for the same.
- A sent a telegram to B,” Will you sell your car? Quote lowest price.” B Sent a reply. “Lowest price Rs. 25,000.” A sent a second telegram to B, “I agree to buy your car for Rs. 25,000.” B thereafter refuses to sell.
- Can A compel B to do so?
- (b) Is there a contract between A and B?
- Ravi promises to make a gift of Rs. 3,000 towards the repairs of a temple. The trustee of the temple on the faith of his promise incurs liabilities. Ravi does not pay. Can the trustee recover the promised amount from Ravi?
- G pays Rs. 500 to A, a civil servant employed in a Government department, in consideration of A’s promise that a Government contract which is at the disposal of his department will be placed with G. Before this can be done, A is transferred to another department. G now wishes to reclaim from A Rs. 500 paid to him. Will G succeed?
- ‘M’ made a contract with ‘N’ for supplying to him certain goods at a place outside the State when there was no prohibition against sending the goods outside the State. Subsequently prohibition was imposed on the sending of those goods to that place and the railway booking was consequently closed. M, failed to supply the goods . N sued M for damages for non-supply of goods. M, inter alia, pleaded that the contract became impossible of performance and so he was absolved from performing it. Will M succeed in his said defence?
- X commenced a periodical publication called, the Armour, and engaged Y to write a volume on ancient armour for it. For this Y was to receive the sum of Rs. 10,000 on completion of the work. When he had completed a part, but not the whole of his volume, X abandoned the publication. Y sued X for recovery of the amount contracted for .Advise Y.

- F offered, by letter to buy B’s horse for Rs 3,00,000, adding ‘If I hear no more from you, I shall consider the horse mine at Rs 3,00,000.’ No answer was given by B. Is there a contract?
- A contract is made for the sale of certain jewellery for Rs 5 Lakhs. The buyer deposited Rs 50,000. Subsequently, the seller gave the buyer a notice to deposit the balance amount. The buyer did not respond. The jewellery was then resold for Rs 4 Lakhs. Can the seller recover the shortfall in the price from the previous buyer?
- X agrees to sing at Y’s theatre on 1st Jan 2013.. X received Rs 1,000 as advance but failed to turn up due to a sudden heart attack on 1st Jan 2013. Advise Y as to the appropriate legal remedies available to him.

- Mr. David, who is the first inventor of an industrial design, would like to get his invention patented. What is the procedure for the grant of patent?
- Mr. Salman promised to supply fifty floral bouquet to Mr. Saif for the company’s anniversary function by eight in the evening. But Salman could not supply nor informed about the reason for the breach of contract. What remedies are available to an aggrieved party on the breach of contract?

- Kanta Bhakta, MumbaiV/s A Jeweller in Dadar, Mumbai
On March 18, 2011, Kanta Bhakta purchased a pair of bangles and a single bangle from a jeweller in Dadar. They were declared to be of 22 carat gold purity and accordingly she was charged for gold of 22 carat purity plus an additional amount as making charges. After the purchase, the bangles were kept in her locker. Both during Diwali 2010 and at the marriage of a relative, her daughter used the bangles. By coincidence, the complainant came across the X-ray gold testing facility of Tanishq Jewellers who were offering to check the purity of gold through an X-ray test which was non-destructive. Out of sheer curiosity, she had the bangles tested and to her utter disbelief, found out that they were of less than 17 carat purity and not 22 carat, as had been represented at the time of the sale. Shaken by this discovery, she immediately visited the jeweller from whom she had bought the bangles along with the cash memo. He refused to accept her claim and her efforts to reason with him were in vain.

- A offered to sell his car to B for Rs 60,000. B said “ I accept your offer. Here is Rs 50,000 in cash and a 60 day promissory note for the balance.” Did a contract result?

- Mr. Amanullah, bought a IFB Washing machine for Rs. 25,000 in Jan 2013 from
R.S. Enterprises, Bangalore, authorized dealers of the company. The machine
started giving trouble right from the time of its installation, and on 12th Feb
2013, it started to burn leading to a major fire.
Executives and loss assessors sent by the manufacturer inspected the
damage and estimated the total loss at Rs. 90,000.
However, IFB rejected the claim for compensation on the ground that
there was no manufacturing defect. They also contended that the wiring system
in the complainant’s house was defective.
But Mr. Amanullah was using a number of consumer durables such as
water heater and air-conditioner for many years and they were working
properly.

the servant came to know about the announced reward, she brought an action
against Gauri to recover the same. How must this case be decided? Analyse.

a. An elder brother Venkat on account of natural love and affection,
promised to pay the debts of his younger brother Ranga. The agreement
was put in writing and was registered. But Venkat did not repay the debt.
The brother Ranga repaid the debt on his own and then sued his elder
brother for recovery of the money. Pass a decision to this case with
reasons.
b. A young widow was forced to adopt a boy under the threat of preventing
the body of her husband, who had just died, from being removed for
cremation. Is this adoption valid under law?
c. R is a manufacturer of light bulbs. He advertises in the trade press that in
future the retail price of the bulbs will be Rs 4 and that proceedings will be
taken against any dealer not observing this price. T buys a quantity of the
bulbs from X, a wholesaler. Although T had originally read the
advertisement, he forgot its contents and retails the bulbs at Rs 4.25.

But Venkat did not repay the debt. The brother Ranga repaid the debt on his own and then sued his elder brother for recovery of the money. Pass a decision to this case with reasons.
- A young widow was forced to adopt a boy under the threat of preventing the body of her husband, who had just died, from being removed for cremation. Is this adoption valid under law?
- R is a manufacturer of light bulbs. He advertises in the trade press that in future the retail price of the bulbs will be Rs 4 and that proceedings will be taken against any dealer not observing this price. T buys a quantity of the bulbs from X, a wholesaler. Although T had originally read the advertisement, he forgot its contents and retails the bulbs at Rs 4.25. Advise R.

Mr.Robert, made all the arrangements for Mr.Grey to learn the skill, by spending a lot of time, energy and money. Finally, the day arrived when Mr.Grey became a renowned Billard Player and disputed the payment due to Mr. Robert Yellow. The court held that, Mr.Grey Fello was liable to pay, as the agreement was one for necessaries as it was in effect “for teaching, instruction and employment, being a reasonable one, for the benefit of the infant”.
